§ 22-4. Powers and duties of building official.

  • (a)

    The building official shall enforce the provisions of this chapter and any other provisions of this Code for which that office is responsible, including, without limitation, Chapter 122 and Chapter 130, and is hereby authorized to issue citations for violations of any such provisions.

    (b)

    Upon presentation of proper identification to the owner, agent, tenant or occupant of any property, and with their consent, may enter any land, lot, building, structure, dwelling, or premises during reasonable hours, except in cases of emergency where extreme hazards may exist which involve the potential loss of life or severe property damage, in which case the above limitations shall not apply. Should the building official be denied entry, an application may be made for a search warrant to allow entry, such warrant to be issued by a municipal court judge of the city upon proper application therefor.

    (c)

    Neither the building official nor any duly authorized representative of the same, nor any officer, agent or employee of the city, nor any member of the board of adjustments and appeals nor any of its members, which are charged with enforcement of the building official's responsibilities, shall thereby render themselves personally liable, and are hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of such duties. Any suit brought against any of the aforementioned employee because of the discharging of such duties shall be defended by the city until the final termination of the proceedings.
